What is a Notary?
A notary public is a lawyer, usually a solicitor, who after further qualifications and training is able to verify and certify important documents for use abroad. This is done by adding a certificate with his signature and official seal, which most countries accept as evidence of the authenticity of the document’s contents.
As the qualification is internationally recognised, Notaries can bridge any differences between the legal systems of various countries to ensure international transactions are completed lawfully. Their work requires a high standard of care, to ensure that errors, omissions, alterations, fraud and forgery do not occur.
Steven Hardy has qualified as a Notary. He is one of approximately 900 people in England and Wales to hold the position, which has been recognised in English law since 1801 but can be traced back more than 2,000 years. The role of notary is regulated by the faculty Office of the Archbishop of Canterbury.
Steven is always happy to give an initial opinion on any Notarial matter, along with an estimate of the likely cost of his services.
Common Notarial tasks
Many Notaries carry out work for commercial firms who trade internationally and private individuals. The most common tasks are:
- preparing and witnessing powers of attorney for use overseas
- dealing with the purchase or sale of land and property abroad
- providing documents to deal with estate administration for people who are abroad, or own property abroad
- authenticating personal documents and information for immigration or emigration purposes, or to apply to marry or work abroad
- authenticating company and business documents and transactions.
Notaries can also offer authentication and a secure record for almost any transaction, document or event and carry out any form of legal work, except for taking cases to court.
The role does not generally include giving advice or drafting documents, unless this has previously been agreed in writing.
